An Agreement Till It Is Maintained By The Other Party

Well I guess that many of you heard and read about the defamation issue which was being done by a certain newspaper against the name Kurt Avish and Island Crisis some days ago. The issue was being discussed on Tushal’s blog.
Just a short post to point out the main points. Infact the chief editor Mr Kodarbux contacted me and we had a small email negotiation which was followed by another negotiation with his current Webmaster. After reviewing the situation, it was brought forward that some articles on IC was directly affecting the newspaper reputation and their work as a whole. The webmaster also mentioned that the articles were affecting his reputation as an individual from his point of view. So we reached a small agreement, where the articles which were affecting the newspaper has been removed or censored where the name of the company was being used against them.
A certain person who is most probably a fan of the concerned newspaper (deduced based on the negotiation email answers from the webmaster) had started a spam blog against the nickname Kurt Avish and Island Crisis some days ago. There was also a defamatory forum post and a fake classified ads on the name of Kurt Avish on the concerned newspaper website. We reached an agreement that both parties remove any defamatory material. As long as the other party respect the agreement, IC will also abide to it.
The post explaining about this whole shameful issue on Tushal.net has also been removed and we are expecting that the illegal blog to be also fully deleted by the next few hours so that the agreement is maintained concerning part 2.
The agreement is detailed view:
Part 1
Island Crisis agreed to remove all possible defamatory content toward the concerned newspaper as long as the newspaper website also abide to the agreement and remove and moderate all post which can cause defamation to Island Crisis and its author/s.
Part 1 of the agreement is being maintained by both parties.
Part 2
Part 2 of the agreement was about the SPAM blog which was created by possible a fan of the accused newspaper. The agreement was that the spam blog had to remove all defamatory content against Island Crisis and any other bloggers and in return the post on tushal.net explaining about the defamation issue against the webmaster of the concerned newspaper and the set of 3 user submitted articles against the specific spam blog and related persons will not be published on our side.
Part 2 of the agreement has been followed but only to some extent. IC and any other cooperating blogs will not be publishing the 3 user submitted allegation post against the concerned splog and related persons as the spam blog has deleted the defamatory parts on their side. However to complete part 2 of the agreement, we had asked that the Splog to be deleted as a whole and then the post on Tushal.net explaining about the issue would be deleted as a whole too. Since part 2 of the agreement has not been followed completely, the post concerning the issue can be republished at the discretion of the owner of tushal.net – The post will be maintained as unpublished for the time being and if that spam blog is not deleted by tomorrow morning, then the post at tushal.net can be republished at anytime depending on the owner’s wish.

This is clearly wrong. We had nothing to do with the splog. I would like you to correct the above.
We just wrote a review of the situation on our forum. I agree that I might have pushed it a little too far, but honestly I just followed in your footsteps Avish. You used to go way over the line with all the expletives you used against us. I didn’t fall so low though.
The fake classified ad was sent in by some unknown user who signed up on the website. I don’t have time to check each ad one by one. Sometimes I might miss one or two fake ones.

Well it has been modified.
From the negotiation emails, it is concluded that the person who is maintaining that splog, knows you, even if you have nothing to do with the setting up of that splog. So I expect that you will extend your effort concerning the removal of the blog and keep by the agreement.

Whatever agreement Avish and Mr Webmaster had, shall not affect any of my future posts. If one day, I find something to discuss about Defi Media or any of its subsidiary companies , I shall write it without the approval or the permission of anyone except the Admins of Tushal’s Freeworld. Under no circumstances shall I be made responsible for breaking whatever agreement both of you had. I am and I shall remain a 3rd Party to that agreement.

@Tushal: ofcourse bro. Well on my side I maintain the agreement till he maintain it only too. However if somewhere at anytime they are wrong or write smthing against me and I am concerned with this then ofcourse I will have to defend myself too… I think its natural for all of us na.

It was part of the agreement that I had with Avish. You’re free to reinstate it though… just like we’re free to do what we will do in case you do that.

Who told you that I have the intention of deleting my blog?
And yes, you had an agreement with Avish and not with me. It does not mean if tomorrow, I write something about Defi Media you need to re post those posts since the posts have and will have nothing personal against you. You can’t take my right from me just because you’re unhappy when people write something about Defi Media. Will you go and kick everyone who hates Defi Media? I know a large group of people who don’t like reading Defi Plus. Will you go and place a bounty on their heads?
